Terms and Conditions of Sale — FootJoy® MyJoys™ Golf Shoes
PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
This Agreement and any documents referenced here contain all of the terms and conditions that apply to purchases of MyJoys golf shoes by you (“Customer”) from Acushnet Company ("FootJoy") sold by FootJoy in the United States. By accepting delivery of the MyJoys golf shoes listed on the applicable invoice, Customer agrees to be bound by and accepts these terms and conditions. If, for any reason, within 30 days, you are not satisfied with your MyJoys golf shoes, you may return them under the terms and conditions of FootJoy's Return Policy which is located online at http://www.myjoys.com or may be found in the documentation accompanying the shipment.
These terms and conditions are subject to change without prior written notice at any time, in FootJoy's sole discretion.Â
Governing Law. THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.
Payment Terms. Payment must be received by FootJoy prior to FootJoy's acceptance of an order. Payment for the products is to be made by credit card at time of order. Orders are not binding upon FootJoy until accepted by FootJoy.
Shipping Charges. Separate charges for shipping and handling will be shown prior to order and on the invoice(s).
Sales and Use Tax. Tax is charged for orders shipped to states where sales taxes are applicable. The amount of sales tax charged is based on current state and local tax rates as well as other factors, including: the identity of the seller, the type of item purchased, and the shipment destination of the order. Applicable sales tax will be automatically charged to orders that are shipped to AR, AZ, CA, CO, CT, DC, FL, HI, IA, ID, KS, KY, LA, MA, MD, ME, MI, MN, MO, NC, ND, NE, NJ, NY, OH, OK, RI, SC, SD, TX, UT, VA, WA, WI, WV, and WY.
Risk of Loss. Loss or damage that occurs during shipping by a carrier selected by FootJoy is FootJoy's responsibility.
Warranties. THE LIMITED WARRANTIES APPLICABLE TO FOOTJOY MYJOYS SHOES, DRYJOYS CATEGORY ARE INCLUDED IN THE DOCUMENTATION PROVIDED WITH THE PRODUCTS AND CAN ALSO BE LOCATED ONLINE AT WWW.MYJOYS.COM.
Return Policies. MyJoys golf shoes that are purchased directly from FootJoy by an end-user Customer may be returned by Customer in accordance with FootJoy's Return Policy in effect on the date of receipt. FootJoy's Return Policy can be found at http://www.myjoys.com or in the documentation provided with the MyJoys shoes.
Exchanges. FootJoy will not exchange custom MyJoys shoes. If a problem exists, the customer may return the product in accordance with FootJoy's Return Policy and receive a credit. Customer will be notified by email of credit issuance. It is the responsibility of the Customer to place a new order at http://www.myjoys.com, if replacement shoes are desired.
Products. The product shown on www.myjoys.com is an actual sample product of potential MyJoys golf shoe color combinations. Due to natural variations in leather, the actual product color(s) may vary slightly. FootJoy is not responsible for variations of on-screen computer resolution and color calibration. This may result in a slightly different image of product on-screen versus end product delivered to Customer.
Limitation of Liability. FootJoy will not be liable for any failure or delay in performance due in whole or in part to any cause beyond FootJoy’s reasonable control including, but not limited to, strikes, riots, wars, fires, acts of God or acts of compliance with any law or regulation. In no event shall FootJoy be liable to Customer for any (i) special, indirect, incidental or consequential damages, or (ii) any damages resulting from loss of use or profit.
Applicable Law; Not For Resale or Export. Customer agrees to comply with all applicable laws and regulations of the various states and of the United States. Customer agrees and represents that it is buying for its own use, and not for resale or export.
